Digital Distribution of SDS: Automatic Portal for Safety Data Sheets

Article 31 of the REACH Regulation requires suppliers of hazardous substances and mixtures to provide their customers with an up-to-date Safety Data Sheet (SDS). Distribution via paper or email attachment does not guarantee traceability, does not confirm receipt, and does not provide any documentary evidence in the event of an inspection. kemXpro solves this problem with a dedicated digital portal for the automatic distribution of SDSs.

REACH obligations on SDS distribution

The REACH Regulation (EC) 1907/2006 establishes specific obligations regarding the provision of Safety Data Sheets. Article 31 requires that the supplier of a substance or mixture classified as hazardous provide the recipient with an SDS compiled in accordance with Annex II of REACH, the format of which is defined by Regulation (EU) 2020/878. Article 31(3) also stipulates that, for mixtures not classified as hazardous but containing substances with occupational exposure limits, PBT/vPvB substances, or substances included in the Candidate List SVHC in concentrations above 0.1% w/w, the SDS must be provided at the request of the recipient.

Article 31(9) also imposes an update obligation: when the SDS is revised (following new information on hazards, new risk management measures, the granting or refusal of an authorization, or the imposition of a restriction), the supplier must provide the updated version free of charge to all recipients to whom they have supplied the substance or mixture in the previous 12 months. This retroactive obligation makes it essential to have a system in place that tracks who received which version of the SDS and when.

The consequences of non-compliance with these obligations include:

  • Administrative penalties — Significant fines varying by Member State, which can reach tens of thousands of euros per violation
  • Civil liability — In the event of an accident, the absence of proof of SDS distribution aggravates the supplier's position
  • Non-compliance during inspections — Competent authorities may request evidence of distribution of updated SDSs
  • Loss of customers — Large industrial groups require documented and verifiable SDS distribution processes

Why Traditional Distribution No Longer Works

Traditional SDS distribution — printing on paper, sending via email with PDF attachments, uploading to shared FTP — has structural limitations that make effective compliance with Art. 31(9) of REACH impossible:

  • No traceability of receipt — An email sent is not an email read. Read receipts are unreliable, easily disabled by the recipient, and do not constitute legal proof
  • Impossible to track versions — Who has which version of the SDS? Has version 3.2 of product X been received by customer Y? With paper and email, this information simply does not exist
  • Unsustainable manual distribution — For example, a company with 500 products and 200 customers that updates 20% of its SDSs each year could have to manage up to 20,000 individual mailings — a huge administrative burden that is prone to errors
  • No audit trail — In the event of an inspection, proving that you have distributed the updated SDS to all recipients in the last 12 months requires manual reconstruction work that can take days
  • Duplication and obsolescence — Customers accumulate obsolete versions of SDSs, with the real risk of using outdated safety information

Dedicated Customer Portal with Access Control

kemXpro provides each company with a dedicated customer portal where SDS recipients can access the product sheets for the products they purchase. Each customer sees only the personalized product catalog based on the products actually supplied. Access is protected by authentication, and the portal supports the management of different roles: safety manager, purchasing manager, and warehouse operator can have different access levels.

The portal eliminates the need to send SDSs individually: customers access the portal independently, always download the most up-to-date version, and the system records each access. This model complies with Art. 31(8) of REACH, which allows the SDS to be provided in electronic format, provided that the recipient has access.

Automatic Revision Notification

At the heart of the kemXpro digital distribution system is automatic notification. When an SDS is revised in the kemXpro authoring system—for any reason (CLP classification update, new risk management measures, change in exposure limits, regulatory update)—the system automatically identifies all customers who have received the product and sends a notification. The process is completely automatic:

  • Identification of recipients — The system cross-references the revised SDS with the supply history for the last 12 months
  • Multi-channel notification — Email with a direct link to the portal, in-app notification for active users
  • Evidence of change — The notification clearly indicates the revision number, date, and a summary of the changes made
  • Automatic escalation — If the recipient does not access the new SDS within a configurable period, the system sends automatic reminders

Documented Receipt Confirmation

kemXpro's receipt confirmation feature provides documentary evidence that the recipient has actually received and consulted the updated SDS. When the customer accesses the portal and views or downloads the SDS, the system records:

  • User identity — Who accessed the portal (name, role, company)
  • Date and time — Precise timestamp of access
  • Action performed — Online viewing, PDF download, eSDS download
  • SDS version — Revision number and date of the SDS viewed

This information is available in the form of an exportable report, ready to be presented during inspections by the competent authorities or customer audits.

Complete Audit Trail and Reporting

kemXpro maintains a complete audit trail of every operation related to SDS distribution. Each event is recorded with a timestamp, user, and action details:

  • Publication — When a new SDS or revision is published on the portal
  • Notification — To whom the notification was sent and when
  • Access — Who viewed the SDS, when, and in what format

  • Confirmation — Explicit confirmations of receipt by recipients

Reports can be generated by product (all distributions of a specific SDS), by customer (all SDSs distributed to a specific customer), or by period (all distribution activities within a date range). Export formats: PDF, Excel, CSV.

  • The author drafts or updates the SDS in the kemXpro authoring module
  • The reviewer approves the SDS following the configured quality assurance process
  • The approved SDS is automatically published on the customer portal
  • The system automatically notifies all relevant recipients
  • The audit trail records every step of the process
